The Guarantor of The Constitution Manipulates Justice

Mr. Holovaty also expressed the opinion that Mr. Kuchma, when he commented on the Vyshhorod District Court canceling the results of the Kyiv mayoral elections (the President said, in particular, that “in this situation the Supreme Court chairman should draw conclusions about the objectivity of the judicial system”), in fact blamed Supreme Court Chairman Vitaly Boiko for the absence of independence and fairness in the judicial system. According to Mr. Holovaty, the Constitution of Ukraine bans the Supreme Court chairman from interfering in the proceedings of district and regional courts. Interfax-Ukraine reports Mr. Shyshkin saying that “if a similar situation had arisen in any other normal country, the president would face nothing but impeachment, but our non-guarantor of the Constitution takes the liberty of commenting on a first-instance-court decision that has not even taken effect.”
